Partner and family

Proving a genuine and stable relationship

Genuine couples are declined on evidence, not on authenticity. The gap is usually coverage: documents that show a shared life across the whole period.

Three separate tests

Immigration New Zealand is asking whether the relationship is genuine, whether it is stable and likely to continue, and whether you live together. They are assessed separately, and a relationship can plainly satisfy the first two and fail the third.

That is why declines feel unfair to people whose relationships are entirely real. The question is never whether you love each other. It is whether the file shows two people living one life, continuously, in a way a stranger can verify.

Coverage beats volume

The most common failure is not thin evidence. It is patchy evidence.

Applicants send a great deal about one period, usually the most recent or the most photogenic, and very little about the rest. What officers look for is a continuous thread across the whole period being claimed.

A joint bank account with small ordinary transactions every month for two years is worth more than a single large shared purchase. A power bill in both names each quarter is worth more than a wedding album. Aim for continuous and boring rather than impressive.

What actually carries weight

Living together. Tenancy agreements or a mortgage in both names, utility accounts, insurance, and correspondence from unrelated organisations arriving at the same address for both of you across the period.

Shared finances. Joint accounts, shared bills, regular transfers between you, one supporting the other, policies naming each other.

Recognition by others. Statements from family, friends and employers who know you as a couple. These carry more weight when the writer explains how they know you and over what period, rather than asserting that the relationship is genuine.

Formal commitments. Wills, next of kin and emergency contact records, beneficiary nominations, shared responsibility for children.

Photographs. Useful, and the weakest category on its own. Spread across the relationship rather than one occasion, and worth far less than the documents above.

Explain the gaps

Real relationships include time apart for work, study, family illness or visa reasons. None of that is disqualifying.

What damages an application is a gap the file does not mention and the officer finds anyway. It puts everything else you said in doubt. Flight records, messages spanning the period, and a plain explanation are all it takes.

The same applies to previous relationships, previous marriages and previous applications. Immigration New Zealand frequently holds the record already.

If there is an interview

Interviews happen, and they are not a trap.

Two people who genuinely share a life give consistent accounts without effort, because they are describing something they remember. Two people who have rehearsed answers tend to conflict, because rehearsed detail is fragile and real memory is not.

The advice is straightforward: do not prepare a script. Answer from memory, and say so when you do not remember something. “I do not remember which day that was” is an ordinary human answer. A confidently wrong date is worse.

Arranged marriages, and cultures where this is documented differently

Arranged marriages are recognised. A culturally arranged marriage is handled under different rules from the ones on this page, and Immigration New Zealand says so directly.

The reason is the living together requirement. The ordinary partnership rules assume you have already lived together, and a couple brought together through a cultural tradition usually has not. So the route is the Culturally Arranged Marriage Visitor Visa, which exists to let you begin living together, rather than a partnership application you cannot yet evidence.

To use it, the marriage has to have been arranged by someone other than the two of you and follow an identified cultural tradition. Understand this early, because it decides which visa is realistic and when, and applying under the ordinary partnership rules first is a common and expensive detour.

Similarly, in communities where everybody knows a couple is together, files are often thin. Nobody involved has ever needed to prove it. Immigration New Zealand is a stranger to your life and works only from what is in front of it.

If the relationship ends

A visa granted on the basis of a relationship is affected when that relationship ends, and you are generally required to notify Immigration New Zealand.

There are specific provisions where a relationship has ended because of family violence, and they exist so that nobody has to remain in a dangerous situation to keep a visa. If that is your situation, get licensed advice quickly, because the options narrow with time. If you are in immediate danger in New Zealand, call 111.

Licensed advice

Need advice on your own situation?

This site explains how the rules work. It cannot tell you what will happen in your case, because that depends on facts only an adviser who has seen your file can weigh up.

In New Zealand it is a criminal offence to give immigration advice without a licence or an exemption. ProVisas holds IAA licence 201301110.
